Second Marriage in Pakistan — Legal Rights, Process and What Both Wives Must Know
Second marriage (polygamy) is legally permitted in Pakistan under specific conditions — but those conditions are strict, and violations are criminal offences.
The Legal Requirements for Second Marriage
Under the Muslim Family Laws Ordinance (MFLO) 1961, Section 6:
- A man must obtain written permission from the Arbitration Council before marrying again
- The Arbitration Council must determine whether the proposed marriage is necessary and just
- The first wife must be given notice and an opportunity to be heard
- The council considers the husband's financial ability to maintain multiple families equitably
⚠️ Without Arbitration Council Permission: The husband is liable to imprisonment up to 1 year AND/OR fine up to Rs. 5,000 under MFLO. The first wife can also seek immediate dissolution of the first marriage.

- Right to immediately apply for divorce/khula upon second marriage without permission
- Continued maintenance rights — cannot be reduced due to second marriage
- Separate accommodation — husband must provide comparable housing

- Full mehr as stipulated in her Nikah Nama
- Equal maintenance — the same standard of living as the first wife
- Equal time allocation — Islamic law requires equitable distribution of time
- Children's rights identical to those of the first wife's children
Reality of Polygamy in Urban Pakistan
Many second marriages are conducted secretly, without the Arbitration Council process. This creates legal vulnerability for the second wife — her marriage may be challenged, and her children's legitimacy can be questioned in inheritance disputes.
💡 Second Wife Protection: Always ensure the Nikah is registered at the Union Council with the second wife's name officially recorded. Insist on registration — an unregistered Nikah provides minimal legal protection.
Islamic Framework on Polygamy
Islam permits up to four wives but conditions this on absolute justice between them — in time, financial provision, and emotional treatment. The Quran itself warns: "you will not be able to be just between your wives, even if you try" (4:129) — which many scholars read as a near-prohibition given human nature.
