Understanding the Difference: Talaq vs Khula

The Talaq Process in Pakistan
Step 1 — Notice to Union Council/Arbitration Council
The husband (or his representative) must serve written notice of talaq to the Chairman of the local Union Council AND the wife simultaneously, under MFLO 1961.
Step 2 — Arbitration Period (90 Days)
The Union Council constitutes an Arbitration Council to attempt reconciliation. Divorce does not take effect until 90 days after the notice — unless the wife is pregnant, in which case it takes effect after delivery.
Step 3 — Certificate of Divorce
After 90 days and completion of iddah, the Union Council issues a Certificate of Divorce. This is the official legal document.
The Khula Process in Pakistan
Step 1 — File Suit in Family Court
File a Khula suit at the local Family Court with your Nikah Nama, CNIC, and grounds for dissolution.
Step 2 — Service and Response
The court serves notice to the husband. He has the right to contest.
Step 3 — Reconciliation Attempt
Court must attempt reconciliation. If the wife is firm, the court proceeds.
Step 4 — Decree of Khula
Court issues Khula decree. Wife returns the mehr agreed in the Nikah Nama. Iddah of 3 menstrual cycles begins.
Women's Rights in Divorce
- Mehr (Dower): Full amount owed on talaq — any unpaid portion is a debt
- Maintenance during Iddah: Husband must provide housing and expenses during iddah
- Child custody: Mother has default custody (hizanat) of sons until 7, daughters until puberty under Hanafi law. Courts now prioritise child's welfare.
- Child maintenance: Father must pay maintenance regardless of custody arrangement
When Husband Refuses to Give Talaq
Under Pakistani law, a wife does not need her husband's consent to obtain Khula. The Family Court can dissolve the marriage even if the husband refuses.
