Contemporary scholars including Sheikh Abdullah bin Bayyah, the European Council for Fatwa, and many major fatwa bodies hold that online nikah is valid IF: the ceremony is live (not recorded), all parties and witnesses can see and hear each other simultaneously, and identity is verifiable. The camera provides the equivalent of physical presence for the purpose of simultaneous communication.
Traditional scholars argue that the witnesses must be physically present — not present through a screen. Physical co-presence is a condition, not merely the ability to communicate. These scholars recommend following up an online ceremony with an in-person nikah when physically possible.
If circumstances absolutely require an online nikah: ensure at least two witnesses are physically present with each of the two parties (so four witnesses total, two with the bride and two with the groom, all on video simultaneously). Conduct an in-person nikah ceremony as soon as the couple is physically together — this resolves all scholarly concerns definitively.
