Your Legal Options
- Khula โ you have the right to seek a court-granted divorce without your husband's consent. This is your Islamic and legal right. See our full khula guide.
- Adultery under Pakistani law: Section 496-B PPC makes fornication (sex outside marriage) a criminal offence if you can prove it. This is difficult to prosecute but creates legal leverage.
- Dissolution of marriage on grounds of cruelty: If infidelity involves neglect, financial deprivation, or emotional cruelty โ grounds for dissolution under DMMA 1939.
- Maintenance: Your husband is legally obligated to provide maintenance (nafaqah) regardless of the state of the marriage. Courts enforce this.
