Islamic Conditions for Polygamy
Quran 4:3 — "Marry women of your choice, two or three or four — but if you fear you will not be just, then marry only one." Justice between wives is a condition, not a suggestion.
- Maximum of four wives simultaneously (Quran 4:3)
- Absolute condition: equal treatment in housing, financial provision, time, and companionship
- The Prophet ﷺ warned those who lean toward one wife: they will come on the Day of Judgement with one side drooping
- If a man cannot guarantee equal treatment — polygamy is haram for him specifically
Pakistani Law: Muslim Family Laws Ordinance 1961
- A man must obtain written permission from the Arbitration Council before contracting a second marriage
- The application must be submitted to the Union Council, which will notify the existing wife
- The Arbitration Council can grant or deny permission
- Marrying without this permission is a criminal offence under Pakistani law — punishable by imprisonment up to 1 year and/or fine
- The second marriage is not automatically void — but the man is criminally liable
First Wife's Rights
- She has the right to be informed and to participate in the arbitration process
- She can seek divorce (khula) if her nikah nama includes a clause making polygamy grounds for dissolution
- Her maintenance rights continue regardless of a second marriage
Reality Check
Many Pakistani men bypass the legal process — the second nikah happens without Arbitration Council approval. This is both illegal and harms the first wife's legal standing. The first wife's rights are best protected when the legal process is followed.
