If He Dies During Khula Proceedings
If your husband dies while khula proceedings are ongoing and no divorce has been finalised:
- You are legally a widow, not a divorcee
- Your iddah is the widow's iddah — 4 months 10 days
- You are entitled to your widow's inheritance share of his estate
- The khula proceedings end — there is nothing to dissolve as the marriage ends automatically at death
This can actually work in your favour financially if you had not yet accepted unfavourable khula terms — you may inherit more as a widow than you would have received in a khula settlement.
If He Dies After Talaq But Before Registration
If he verbally pronounced talaq but it was not yet registered:
- Under Pakistani law, talaq becomes effective 90 days after the Union Council notice (arbitration period)
- If he dies within this 90-day period, scholars and courts differ on the status
- Consult a family law lawyer and an Islamic scholar immediately — this requires case-specific advice
